The administrative fact: a doctrinal and normative perspective in Ecuador
Synopsis
The present investigative work, through a bibliographic review, addresses the administrative fact that are the operations or physical executions of the administrative function that is directly or indirectly related to the citizen. It is important to clarify that they do not always have the same importance as administrative acts, an act according to the same code stated, are resolutions taken by the administrative authority. Differences are established based on examples, such as the resolution within a corrective administrative procedure where a citizen is penalized for building without a permit would become an act, where the administrative act would be the notification of an administrative action within the same process. It is concluded that administrative acts are not usually subject to control or appeal, unlike administrative acts, which can be reviewed and challenged. In itself, both the act and the fact include the actions and decisions taken in the administrative sphere, which may have legal consequences. Understanding and properly managing administrative events is very important to achieve efficient and effective administration in public proceedings.
