The administrative contract in Ecuadorian public contracting. Absence of contractual freedom?
Synopsis
This research work focuses on the study of administrative contracts derived from public procurement, in order to know its nature and finally to determine whether in this type of administrative contracts there is a contractual freedom or there is an absence of it. Through a qualitative approach research, a bibliographic review is built that synthesizes the beginnings of public procurement in Ecuador, trying to synthesize what is a public procurement or state contracting, the principles that govern in this type of contractual relations, which are characteristic of an administrative contract based on the prerogatives of the State that it has in order to execute its administrative actions; In addition, a differentiation is made between public contract and private contract, due to the fact that historically there has always been a conception of private regulations, which to this day continue to prevail in administrative contracts; and with all this analysis, at the end we will make an analysis and determine whether or not there is contractual freedom in public procurement administrative contracts, or if public procurement involves the contractual figure known as adhesion contract.
