Synopsis

This study analyzes the disciplinary administrative procedure from the perspective of constitutional due process, with the aim of identifying the application of basic guarantees; specifically, the right to constant defense in Ecuadorian law. In this regard, our analysis will be based on the disciplinary administrative procedure as a set of norms and rules established to investigate and punish irregular behaviors or misconduct by public officials (understood as those who have a labor relationship with the administration) in the exercise of their functions. It is important to highlight that the disciplinary administrative procedure must comply with the principles of legality, due process, contradiction, motivation, publicity, among others, in order to ensure transparency and respect for the rights of those investigated, as well as guarantee the fair and proportional application of disciplinary sanctions.
